These Terms & Conditions (the “Terms”) govern your access to and use of the website magnumestate.com and its subdomains (the “Website”), operated by PT Magnum Estate International (“Magnum Estate”, “we”, “us” or “our”). Please read them carefully.
By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website.
1. About us
The Website is operated by PT Magnum Estate International, a company established under the laws of the Republic of Indonesia, with its office at Jl. Bumbak No. 156, Kerobokan, Kec. Kuta Utara, Kabupaten Badung, Bali 80361, Indonesia. We develop and market residential and resort real estate in Bali, Indonesia. It is registered in Indonesia under Business Registration Number (NIB) 1245000742689.

By using the Website you agree to these Terms. We may update them from time to time to reflect changes in our practices, the Website or the law. The updated version applies from the date it is posted, shown by the “Last updated” date above, and your continued use of the Website means you accept the change. You agree that accepting these Terms electronically and using the Website by electronic means is valid and binding under applicable Indonesian law, including the Electronic Information and Transactions Law.

9. Foreign ownership and Indonesian property structures
Real estate in Indonesia is subject to Indonesian law, which restricts the rights that foreign individuals and entities may hold. Foreign individuals generally cannot hold freehold (Hak Milik) title. Ownership is commonly structured through leasehold (Hak Sewa), right to use (Hak Pakai) or a foreign-owned company (PT PMA), each with its own conditions, costs, durations and risks.
Information on the Website about ownership structures is general and may not reflect your situation or the latest regulations. We do not endorse or facilitate arrangements that are unlawful under Indonesian law, including nominee arrangements. 19. Governing law and dispute resolution

The parties will first try to resolve any dispute amicably. If a dispute cannot be resolved within 30 (thirty) days, it will be finally settled by arbitration administered by the Indonesian National Board of Arbitration (Badan Arbitrase Nasional Indonesia, “BANI”) in accordance with its rules in force at the time. The seat of arbitration is Indonesia, and the arbitration is conducted in English (or in Indonesian where required by law). This clause does not prevent us from seeking interim or injunctive relief from a competent court.
20. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemics or pandemics, war, civil unrest, strikes, failures of utilities, networks or third-party services, or acts of government or regulators.
21. General
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Website and replace any prior understanding about it.
- Severability: if any provision is held invalid or unenforceable, the rest of the Terms remain in effect.
- No waiver: our failure to enforce any right or provision is not a waiver of it.
- Assignment: we may assign or transfer these Terms; you may not do so without our prior written consent.
- Headings are for convenience only.
- Language: these Terms may be provided in several languages for convenience; in case of any inconsistency, the English version prevails for interpretation, except where Indonesian law requires otherwise.
